Requests for reconsideration & hearings before a judge

A request for reconsideration is the first level of appeal. To have your case reconsidered you need to contact the Social Security Administration and ask that your case be reconsidered. After completing necessary forms, your case is sent to Disability Determination Services for a decision. Medical evidence is obtained. If it is proposed that benefits should stop, you are offered a face-to-face hearing with a Disability Hearings Officer.

Some of the reasons to request reconsideration are:

  • The condition is more severe than determined
  • The condition has lasted longer than expected
  • Another condition developed that complicates the first condition
  • The condition worsened since the decision
  • The condition became disabling earlier than determined

In Texas, disability claimants must have been denied disability benefits from the Disability Determination Services both at the initial and the reconsideration level before they have a right to an administrative hearing before an Administrative Law Judge (ALJ). The ALJ Hearing is the second level of appeal.

If you are unsuccessful at the ALJ Hearing and disagree with the decision, you can pursue the following actions:

  • Review by Appeals Council: If the ALJ denies your claim after a hearing, you may appeal to the Social Security Appeals Council
  • Lawsuit filed in federal district court: If the Appeals Council denies a request for Appeals Council Review, an appeal may be made to the federal district court

Social Security benefits

For Social security benefits in Dallas, if you applied under the work-related program (SSDI), monthly checks begin after a five-month waiting period for disabled workers and disabled widows/widowers. There is no waiting period for disabled adult children.

If you applied under the means-related program (SSI), there is no waiting period before you start receiving monthly checks.

Once benefits begin, they continue as long as you are still disabled and not working.
